1.-GLOSSARY

“Transport Company” refers to the Company Ángel Unda García (YatchandSun – Y&S) which offers the charter services including crew.

“Charter” refers to the transportation services where passengers are moved from one port to other or back to the same port, sailing in Malaga Bay with a closed itinerary and for no longer than 12 hours. It can include stops or scales during the Service, but the passengers should remain all in the vessel until the Service is due.

“Vessel” refers to the ship or yatch used for navigating in the sea, which is allowed to have passengers on board.

“Rental contract” refers to the transport agreement between the Company and one of the passengers, for the charter Service.

2.- APPLICABLE LAW AND RESPONSIBILITY

The offered charter service complies with the Spanish Law, communitarian rules and International Agreements Spain is a member. In this case, the Maritim Law 14/2024 of july 24th is the one applied regarding the passengers contract.

3.- PASSENGERS CONTRACT

It refers to the document or agreement in which a Transport Company sets a price to offer a transport service to one or several passengers, in the sea, with their own luggage and as a charter service.

The contract details are agreed previously and requires the payment of an amount negotiated with the transport company, in which the passenger has been notified the conditions and terms that rule.

The number of passengers allowed the ones agreed previously and shown in the contract, as well as the date, time, duration and itinerary. The transportation Company will give a copy to the passenger. This is the only document needed in case the passenger/s want to place any complaint.

The Transportation Company has the right to set the prices, make special offers or offer discounts and which will appear in the website. The transport Company also reserves the right to modify these prices without previous notice. The transport Company is not responsible for any luggage or personal belongings the passengers lose during the charter service.

4.- ITINERARY, SHIPMENT AND CANCELLATION RULES

The departure time of each charter Service will be agreed previously with the passenger when booking it in the following website: https://yatchandsun.com/

The transport company has the right to change the departure time or even cancel the service for security, organizational or weather reasons.

The transport Company will inform and determine the “limit boarding time” and will decide to deny the access to the passengers when not arriving on time.

The transport Company has the right to choose the itinerary or change it when considering appropriate or for safety reasons.

In case of cancellations, the following conditions will apply:

  • Before 15 days of the departure date: 100% refund.
  • Before 10 days of departure date: 75% refund.
  • Before 7 days of departure date: 50% refund.
  • Before 24 hours of departure time: No refund.

5.- CONDUCT ON BOARD

The captain is the only responsible of the direction of the vessel and has the authority to make any decision to keep the order and safety in the vessel, when needed. The passengers are obligated to follow any of the captain’s orders, without affecting your right to place a complaint if applies, once arriving to the destination port.

6.- TAXES LEGISLATION

According to the Law 37/ 1992 of December 28th, the tax applicable is the 21%, which correspond to charter Service.
